I'm starting an online marketplace for baton twirling competition management/registration, and am looking to speak with a sales tax expert to answer a few questions. Background on the Business: On my site, event organizers are the sellers and attendees, usually parents of children who will be competing, are the customers. A single registration typically consists of multiple selected "disciplines," one for each different skill the athlete will compete in, similar to gymnastics. Besides the discipline entries, event organizers sometimes sell physical goods such as t-shirts and towels, or offer instructional classes that people can sign up for. My Needs: I'm looking to understand the tax liability of these sales and how to classify each of them in Stripe. I've already started running contests and would also like to discuss economic nexus status for Pennsylvania (where I live), Ohio, and West Virginia. Finally, I'm curious about the sales tax remitting process and hoping to get advice on keeping those costs as low as possible. In summary, my questions include: 1) Are the discipline entries considered "services"? Is there a more specific classification I should use? 2) Do I need to register for state sales tax reporting every year in each state where I reach nexus? Or does a registration last for longer? 3) Does economic nexus ever reset? For example, if in 2025 I have 150 transactions in a state that starts requiring taxes after 200 and then in 2026 I have 50 more, does that count as 200 or just 150 and 50, separately? 4) Similarly, if I have 200 transactions in a year and then less than that in subsequent years, at what point (if any) should I no longer collect sales tax? 5) Finally, I'm seeking guidance from a tax perspective on the viability of my business model. As a marketplace facilitator, I manage the transaction between buyers and sellers, and collect a small fee off of each transaction. As the business grows, so will my tax liability, and I want to make sure my rates are profitable. The Task: For this job, I'm looking to have a conversation to answer these questions.
